Over 53 million pounds was paid out last year for people claiming from accidents that involved potholes. A pothole in the roads surface or worse on a public footpath or highway or even on private or business premises can be responsible for serious personal injury. The result of such an accident could be injuries from slips or trips due to the occurrence of the pothole.

The majority of maintenance that is carried out to local pavements and roads is predominantly the responsibility of the local council's highways department. The highways department is required and is responsible for putting adequate inspection and maintenance systems in place to deal with pothole repairs. The council may be liable for any accident due to a pothole if they knew about the problem or pothole and had failed to act on the information that they had been given. Pothole claims can be difficult to prove as a council is expected to regularly inspect their pavements and highways in order to identify defects and thereafter is expected to rectify faults within a reasonable time.

Councils regularly inspect pavements and highways and we are aware that they are not expected to be totally smooth and level and there is a factor that has to be taken into consideration when looking at a claim, Generally a depth of at least 2cm's can be classed as an irregularity in a pavement. This is often referred to as the depth of trip. Most potholes will clearly have a depth of trip in excess of this and it is therefore only necessary to show that the last inspection was outside of the accepted parameters or that a repair has not been affected within a reasonable time scale if the council already knew about the defect. The local council's inspection records are open for public scrutiny.
