The ability to claim compensation against airlines for delayed flights has received a boost by a recent court ruling that restricts airlines from attempting to cut the time passengers have to claim by adding reducing clauses to their small print. This means you have a full 6 years from the date of your flight to make a claim, whatever your airline has tried to get you to agree to in its terms and conditions when you purchased the flight.

So how do you claim? And what might you receive?

Fundamentally airlines are businesses, and they want to limit the amount they are losing through compensation paid. Therefore, they aren’t going to make the process easy for you: where possible they will try to deny responsibility. As a result, it is important to use legal specialists who are experts in ‘playing the game’ and know the tricks that airlines will try and secure the money you deserve to receive for the delay. Fundamentally, legal experts like Attwoods will take the stress out of the claims process for you.

Compensation is set by the EU, not airlines, and not done on a case by case basis. There are set figures for what you will receive if your claim is successful. These amounts vary from roughly £180 – £440 depending on the length of the delay (it must be at least 3 hours) combined with the distance to be travelled. The amount payable is compensation for the delay not a refund of the ticket price.

Importantly, your situation must meet the following conditions:

  • Your flight must have started or finished in the EU (including Norway, Switzerland and Iceland)

  • The delays need to have been the airline’s fault
  • The delay must be 3 hours or more to qualify

To refute your claim, and avoid paying compensation, an airline will try to argue that there were ‘extraordinary circumstances’. This may be applicable in cases such as a security risk, or severe adverse weather conditions. However this doesn’t include issues such as staffing problems, or technical issues that should have been identified during routine checks. It is not always clear cut whether there were ‘extraordinary circumstances’ at play, and as such you need legal experts to use their knowledge for you and navigate the system on your behalf.
