			<content:encoded><![CDATA[Ex-potter Adrian Ward has been awarded £3,000 in compensation from the insurers of pottery manufacturer John Tams Group PLC, after lawyers successfully argued that his hearing loss was caused as a result of working in an excessively noisy environment over an extended period without sufficient ear protection.
<br /><br />
Following a court ruling in 2009, workers can claim compensation if it can be proved that they were exposed to more than 80 decibels of noise at work on a regular basis.
<br /><br />
Adrian said: “I worked for 20 years for John Tams and it was very noisy. In the old-fashioned factories a siren would go off on the kiln and the sound was deafening. You could hardly hear yourself think and we were never offered earplugs. If people are talking but not facing me, I find it very difficult to hear and it can be dangerous at work.”

One of Stoke-on-Trent’s largest ceramic cup producers, John Tams Group operated a number of pottery factories across the city, including the Royal Grafton Works, Atlas, Sutherland and Monarch.
<br /><br />
At its height, the pottery industry employed around 70,000 people in North Staffordshire. Burslem-based Attwood Solicitors have already taken on more than 1,000 cases.
<br /><br />
John Farrow from Attwood Solicitors said: “We are close to recovering a total of £1 million in damages for hearing loss clients.”
<br /><br />
In 2005 the Noise at Work Regulations Act was passed. This act helps ensure workers are protected from excessive noise at work. However, according to a report by the Royal National Institute for the Deaf and the Trades Union Congress, employers are &#8216;doing little&#8217; to protect the hearing of their employees. Under the regulations, employers can be prosecuted if they fail to protect employees’ hearing when they are exposed to noise above 85 decibels.

Others who may suffer Work Related Hearing Loss include pub and club workers, shipbuilders and call centre staff.

Ashley Attwood has been a vocal critic of the Government’s failure to order the replacement of the <strong><a href="http://www.attwoodsolicitors.co.uk/brandnew/new/claim-types/medical-negligence/pip-implants-compensation">faulty French implants</a></strong> on the NHS. Thousands of women in the UK are known to have been fitted with <strong><a href="http://www.attwoodsolicitors.co.uk/brandnew/new/claim-types/medical-negligence/pip-implants-compensation">implants</a></strong> made from low industrial grade silicon. Mr Attwood, who has offered advice to thousands of women caught up in the scandal, said:

“The House of Commons Health Committee report says to put women through two surgical procedures when one would do flies in the face of commonsense. This report must be welcomed and acted upon. We are offering advice to clients throughout the country and believe they should be given the necessary surgery if their private clinic will not help them.”

Mr Attwood is Principal Solicitor at Attwood Solicitors of Stoke-on-Trent. Hip implants have been the subject of controversy, with many patients experiencing serious side effects.

Some doctors believe the cup of metal-on-metal hip implants is too shallow and that this design flaw has led to improper implantations, loosening the hip implant within the body, which may result in the release of potentially dangerous levels of chromium and cobalt ions into the body.

The Food and Drug Administration have received more than 300 complaints in four years about problems with metal-on-metal hip implants, including:
<ul>
	<li>Loose hip cups</li>
	<li>Hip implant dislocations</li>
	<li>Bone fractures</li>
	<li>Pseudotumours caused by metal debris</li>
	<li>Allergic reactions</li>
	<li>Muscle and tissue damage</li>
</ul>
Hip implants are expected to last up to 15 years, but many implant patients have reported that their implants are failing after just two or three years, requiring expensive and painful additional surgery to have the implant replaced.

The British Association of Aesthetic Plastic Surgeons (BAAPS) has issued a press release which highlights the increasing number of women affected by the PIP implants scandal who are being asked to sign waivers relating to their right to take legal action regarding their PIP revision surgery.

At Attwood Solicitors, we have been contacted by many women regarding whether or not these waivers should be signed.

We intend to argue that the waivers are unenforceable, as they were signed under undue pressure. Many PIP victims have been asked to sign these waivers only hours before revision surgery, having already paid for the surgery itself. In today&#8217;s article, BAAPS President Fazel Fatah, urges “women not to let themselves be bullied or pressured into anything they’re not comfortable with.”

However, any woman who has signed a waiver should be aware that this may mean that she is unable to receive any compensation for the faulty PIP breast implants, not only for the cost of the revision surgery but also with regard to the claim for personal injury compensation and the consequential damages. Total costs could run into thousands of pounds over and above the costs of the revision surgery. Anyone who has signed a waiver may forfeit her right to pursue a claim. Ultimately it will be for the courts to decide whether or not these waivers are enforceable.

It may be the case that, if you choose to have your revision surgery at a clinic other than where you originally had your PIP implants inserted, you are not asked to sign a waiver. However, the decision whether or not to sign a waiver is a matter for each woman to decide based on her own personal circumstances.

We ask you to be vigilant if asked to sign a waiver and be aware that although we are prepared to pursue a claim for you whether or not you have signed a waiver, there may be consequences of signing a waiver which may effect your ability to claim.
