With ever increasing, and constantly improving, medical treatments, cancers are often treatable, but recovery and life expectancy rely on accurate diagnosis.
Cancer develops through stages. Where opportunities for diagnosis are missed and the condition advances, the delay may make a significant difference to the outcome. This can happen when x-rays or scans are misinterpreted, tissue samples are misinterpreted, or when there has been inadequate investigation. Late diagnosis may also result in the treatment required being more invasive, painful and distressing. Medical Negligence can occur if there has been a misdiagnosis, a late diagnosis, or a failure to diagnose altogether. Mistakes with a serious condition like cancer can have huge consequences on not only the patient but also their loved ones.
There are also Medical Negligence cases where someone has been misdiagnosed with cancer, potentially causing them to undergo lengthy, unnecessary and unpleasant procedures, for example, in the incorrect removal of healthy breast tissue. They may also have suffered psychologically believing they are terminally ill.
A specialised area of Medical Negligence involves the consequences of Diethylstilboestrol (DES) used in expectant mothers between 1940 and 1971 to prevent miscarriage. It has been proven that DES is responsible for the development of certain cancers in both men and women who were the babies of mother’s prescribed DES. Effects are still coming out and are expected to continue to do so until at least 2040.
